This Privacy Policy explains how Pacific Lime and Cement Limited and its subsidiaries ("PLC", "we", "us" or "our") collect, use, hold and disclose your personal information.
PLC is a public company incorporated in Singapore (Co. Reg. No. 201114015W), listed on the Australian Securities Exchange (ASX: PLA) and the Papua New Guinea Securities Exchange (PNGX: PLC). Our principal place of business is Level 3, 100 Creek Street, Brisbane QLD 4000, Australia.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs"). This policy covers information collected through our website at placltd.com, by email, by phone, in person, and through our operations in Australia, Singapore and Papua New Guinea.
What is personal information?
"Personal information" is information or an opinion about you, or information from which you could reasonably be identified. It includes information from which you can be identified indirectly, such as an online identifier or an IP address.
"Sensitive information" is a sub-set of personal information which includes information or an opinion about your racial or ethnic origin; political opinions; religious beliefs or affiliations; philosophical beliefs; political, professional, trade association or trade union memberships; sexual orientation or practices; criminal records; or your health, genetic or biometric information.
Some of the information we collect is sensitive information, including health or medical assessment information collected for pre employment purposes and fitness-for-work information collected at our sites. PLC will not collect your sensitive information unless:
- you have provided your consent and the information is reasonably necessary for our functions or activities; or
- we are legally required or permitted to collect that information without your consent.
Collection of personal information
What kinds of personal information do we collect?
Depending on how and why you interact with us, we may collect the following personal information about you.
- Contact and identity details. If we are in contact with each other, including if you submit an enquiry through our website, subscribe to updates, apply to work with us, are the contact person for one of our contractors, suppliers or service providers, or are a current or potential investor, we may collect your full name, postal address, email address and telephone number, and the content of your message.
- Subscription and communication preferences. If you subscribe to updates through our website, we collect your first name, last name, email address and the update categories you select, being News, Investor Updates, Media Releases, Careers and SEZ Opportunities. We also record standard email engagement information, including whether an email was opened and which links were followed, so we can tell whether our updates are useful.
- Recruitment and employment-related details. If you are a job applicant, or a current or former employee of or individual contractor to PLC, in addition to your contact and identity details we may collect your curriculum vitae, work history, qualifications, licences, right to work documentation, referee details, and the information required to pay you, including bank account, tax file number and superannuation details. Where a role requires it, and only with your consent, we may collect health or medical assessment information relevant to your fitness for the role.
- Shareholder details. If you hold shares in PLC, your personal information is held on our behalf by our share registry, Automic Registry Services, which maintains the register of members. This typically includes your name, address, shareholding, tax file number if supplied, and bank account details for dividend payment. The registry handles this information under its own privacy policy. - Website interactions. If you visit our website we collect your Internet Protocol (IP) address or unique device identifier, along with other details about your browsing experience, including your browser type and version, device type, approximate location derived from your IP address, the pages you visit, and the site you came from. See also "Cookies" below.
- Social media interactions. If you interact with us on LinkedIn, YouTube, Facebook or Instagram, we may see your public profile information and the content of that interaction. What the platform itself collects is governed by its own privacy policy.
- Community, landowner and stakeholder details. If you are part of a community, landowner group or organisation with whom we are consulting on a project, in addition to your contact and identity details we may collect details of the community, group or organisation you represent, and your preferred manner of consultation.
- Visitor, induction and site access details. If you visit our offices or operating sites, we may collect your name, contact details, emergency contact, the time of your entry and exit, induction and competency records, and fitness-for-work information. Our premises may be monitored by CCTV.
- Supplier, contractor and counterparty details. If you deal with us as a supplier, contractor, joint venture participant, or government or regulatory contact, we may collect your business contact information, contractual details and correspondence.
- Other information or opinions which identify you. We may collect your information, feedback or opinions in relation to PLC's activities and operations, including as part of a consultation process. Depending on what you provide, you could be identified.
In certain circumstances you may choose to deal with us anonymously. However, if you do so we may be unable to identify you as the person who provided particular feedback, to respond to your enquiry, or to provide you with accurate information about our projects or business.
How do we collect your personal information?
We may collect your personal information:
- directly from you, for example when you complete and submit a form on our website, subscribe to updates, email or call us, apply for a role, attend a site visit or consultation session, or enter into a contract with us;
- automatically, through our website and the services that support it;
- from publicly available sources and databases, where it is unreasonable or impractical to collect the information directly from you;
- through statutory, regulatory and other governmental processes; and
- from third parties who you have authorised to provide us with your personal information, including our share registry, recruitment agencies, referees you nominate, and our joint venture and contracting partners.
We only collect personal information that is reasonably necessary for our functions and activities.
If we receive unsolicited personal information about you, we will assess whether we would have been permitted to collect it under the Privacy Act and the APPs. If we would not have been permitted to collect it, we will destroy or de-identify it as soon as practicable, where it is lawful and reasonable to do so.
Disclosure of personal information
Do we disclose your personal information to anyone outside of PLC?
We may share your personal information with the entities forming part of the PLC group, including our Singapore and Papua New Guinea entities, where those entities require the information for the purposes described in this policy. From time to time we may also disclose your personal information to:
- our third party service providers, including providers of website hosting, content management, email distribution, marketing, archival, recruitment, data processing and security services;
- our share registry, for shareholder administration;
- our joint venture partners for particular projects;
- government authorities, regulators and securities exchanges, including ASX, PNGX, ASIC, the Australian Taxation Office, the Accounting and Corporate Regulatory Authority of Singapore and the PNG Securities Commission, where we are required to do so by law or under the ASX or PNGX Listing Rules;
- our professional advisers, including those providing legal, taxation and audit services, where those advisers are bound by obligations of confidentiality;
- where you have applied to work with us, your nominated referees for the purpose of receiving a reference;
- a purchaser or potential purchaser of all or part of our business; and
- any other parties to whom you have authorised us to disclose your personal information.
We will not disclose your personal information to other third parties unless you consent, or unless we are permitted to do so by law.
We do not sell, rent or trade your personal information.
Do we disclose your personal information to anyone located overseas?
Some of the PLC group entities and third parties referred to above are located outside Australia.
The overseas locations to which your personal information may be disclosed, transmitted, stored or accessed from include, but are not limited to, the United States, Singapore and Papua New Guinea.
Our website hosting, content management, email distribution and website analytics are provided by United States based companies. Our email and business systems are provided by a United States based company and hosted in Australia and the United States. Our group entities are located in Singapore and Papua New Guinea.
If we disclose personal information to a recipient located overseas, we will take reasonable steps to ensure that the disclosure complies with the Privacy Act and the APPs. This may include entering into a legally binding contract with the recipient which requires them to protect and handle personal information in accordance with applicable privacy laws.
Purpose of collection, use and disclosure
Why do we collect, use and disclose your personal information?
We may collect, use and disclose your personal information for a number of purposes connected with our business operations, including:
- to respond to your enquiries and provide you with the information or services you have requested;
- to send you investor updates, media releases, news and other communications you have subscribed to;
- to process and respond to your employment application and for other recruitment purposes, including conducting reference checks;
- to manage our relationships with suppliers, contractors, landowners and communities, and to record and respond to feedback you provide during consultation;
- to meet our obligations as an entity listed on the ASX and PNGX, including continuous disclosure and shareholder communications;
- to comply with our legal and regulatory obligations in Australia, Singapore and Papua New Guinea, including work health and safety, taxation, anti bribery and corruption, and modern slavery obligations;
- to maintain the security and performance of our website and systems; and
- to investigate complaints, incidents and suspected breaches of our policies.
We only use or disclose your personal information for the purpose for which it was collected, for a related purpose you would reasonably expect, or where you have consented or the law requires it. Subscribing to one category of update does not mean we will send you another.
Storage and security of personal information
How do we store and secure your personal information?
We take reasonable steps to protect your personal information from loss or misuse, and from unauthorised access, modification or disclosure.
However, there are inherent risks in transmitting data over the internet. While reasonable security measures are in place, no guarantee can be made that your personal information is completely secure.
If any unauthorised access to or disclosure of your personal information occurs, we will comply with our obligations under the Privacy Act, including our obligations in respect of eligible data breaches under the Notifiable Data Breaches scheme in Part IIIC. Where a breach is likely to result in serious harm, we will notify the affected individuals and the Office of the Australian Information Commissioner.
Please let us know immediately if you become aware of any breach of security affecting personal information that PLC holds.
How long do we keep your personal information?
We keep personal information only as long as we need it for the purpose for which it was collected, or as long as the law requires.
As a general rule we retain personal information for seven years from the end of our dealings with you. This reflects the limitation period that applies to most civil claims in Queensland, where our principal place of business is located, and aligns with our record-keeping obligations under the Corporations Act 2001 (Cth) and taxation law.
Some categories are treated differently:
- Marketing subscriptions: If you unsubscribe, we delete your subscription profile within 30 days. We retain your email address on a suppression list indefinitely, for the sole purpose of ensuring we do not contact you again.
- Tax file numbers: Destroyed or de-identified once we are no longer required by law to retain them.
- Community, landowner, agreements executed as deeds and stakeholder consultation records: Retained for the life of the relevant project and for seven years afterwards, because land access, environmental and community commitments can remain relevant long after a project concludes.
- Records subject to a longer statutory retention period: such as certain work health and safety records, are retained for as long as the law requires.
When we no longer need your personal information, we destroy it or de-identify it.
Cookies
Cookies are small data files that a website places on a user's device to record aspects of that user's experience of the website. Our website may use cookies, including cookies necessary for the site to function and analytics cookies which record which pages are visited and how visitors move through the site.
You can set your browser to refuse cookies or to alert you when one is set, although some parts of our website may not function properly if you do.
We do not use cookies to identify you personally, and we do not run advertising or retargeting pixels on our website.
Direct marketing communications
If you are a stakeholder, a potential or actual investor, or a business contact of PLC and you register your details with us, we may send you communications from time to time about our projects, our business, or events we think will be of interest to you.
You can opt out of receiving these communications at any time, by using the unsubscribe facility provided in each communication or by contacting us using the details below. We will action your request promptly.
Opting out of marketing does not stop communications we are required to send you, such as shareholder notices.
Access to, and correction of, personal information
How can you access or correct your personal information?
You may request access to the personal information we hold about you by contacting us using the details below. Upon receiving a request, we may seek further details from you in order to verify your identity. We reserve the right to refuse access if we cannot verify your identity to our reasonable satisfaction. Access will generally be provided in an appropriate format within 30 days.
We will take reasonable steps to confirm that the personal information we collect and use is accurate, up to date and complete. Where personal information is out of date or incorrect, please let us know and we will correct it.
If you are a shareholder and wish to update your registered details, please contact our share registry, Automic Registry Services, on 02 9698 5414, as we do not maintain those records ourselves.
